EMPLOYMENT/LABOR ECONOMICS

ARPC consultants have experience in many aspects of employment and labor economics and provide sound statistical and mathematical analysis to a tightly regulated and emotional part of our clients’ businesses. We often find that even when our clients maintain well-documented employment law policies and procedures, they often face compliance issues requiring an understanding of employment statistics. It is essential for a business to have a clear statistical understanding of its workforce and not react to findings that may be misleading or have outside influencing factors affecting protected issues such as race and gender.

ARPC consultants have experience in workforce reviews and statistical audits in private business as well as a number of state and local government agencies. We can assist our clients in preparing for government audits and provide independent annual reviews that are unbiased by internal employee perspectives. Our work can be used to reduce the probability of future litigation, as well as in evaluating the economic impact of planned reductions in workforce, designing affirmative-action plans, reviewing existing compensation plans, and providing recommendations for compensation systems. We have experience using mathematical models to predict manpower needs for state and local government agencies as well as providing workload and procedural analysis. We also design employee personnel classification and compensation systems for workforces of thousands of employees.

Whether the issue is illegal hiring practices, off-the-clock and overtime matters, or discrimination, the potential damages may be in the millions of dollars. ARPC consultants are well-qualified to calculate damages and also to analyze opposing expert loss calculations, which are often based on misleading statistical models used to confuse juries and inflate damages or to show that there are only inconsequential damages. ARPC experts are also adept at preparing damage calculations based on sound business, statistical and mathematical analysis and in examining but-for and mitigation efforts. Economic losses often take the form of class actions and it is essential to review damages not only as a “whole” for the class, but also to review a statistically valid sample of the individual alleged losses. What applies, as an overall loss to class members, may not be representative of the actual individual losses due in an alleged tort. ARPC consultants are also skilled and experienced in the review of class certification or de-certification.

We are also experienced in consulting with clients regarding labor and workforce matters that have been initiated by a potential OFCCP (Office of Federal Contract Compliance Program) audit or due to an alleged violation involving the EEOC (Equal Employment Opportunity Commission).
