Nels A. Pearsall is a Vice President and member of ARPC’s Leadership Team. He brings more than 20 years experience as an economic consultant and testifying expert to ARPC’s Competition and Intellectual Property Practices. Mr. Pearsall has provided expert opinions and consultation services in numerous matters involving the determination of economic damages in the context of intellectual property rights, commercial disputes and antitrust litigations.

In matters involving intellectual property rights, Mr. Pearsall has provided expert testimony and consulted in numerous matters involving economic damages based on applications of reasonable royalty rates, lost profits, price erosion, and overall changes in firms’ IP asset values. He has testified as to the appropriateness of alternative damage calculations set forth by opposing parties. Mr. Pearsall has been retained as a consultant and has performed economic analyses involving changes in IP values arising from alternative licensing arrangements, industry royalty rates, the introduction and/or existence of substitute products, and other market factors which impact IP asset values and/or profits attributed to such assets. Mr. Pearsall also has been retained to develop economic and financial models to analyze IP asset allocation strategies.

In the context of commercial disputes, Mr. Pearsall has served as a damages expert and has provided testimony and/or expert reports in matters involving, among other things, damages attributed to contractual default, breaches of confidentiality and of fiduciary duty, franchise agreements, wrongful termination in violation of the Sarbanes-Oxley Act, anticipated future income, possible impact on operations following a damage award, econometric analyses used to estimate market conditions, and the impact of proposed public policy.

Mr. Pearsall also has been retained in a variety of different matters involving antitrust issues and has submitted expert reports and analyzed damages associated with anticompetitive practices. He has provided economic analyses of liability and damage claims in antitrust matters involving allegations of attempted monopolization, predatory pricing, price fixing, vertical restraints, collusion, price discrimination and improper use of market power.
